City Settles Lost Dimensions Nuisance Case
GREENSBORO, NC (May 7, 2010) – The City of Greensboro announced today, Friday, May 7, the settlement of the public nuisance lawsuit filed against Darryl McCarroll, Sugar Bare Entertainment Inc. and Clarence Ray Jernigan. The lawsuit revolved around a nightclub located at 510 Farragut St. in Greensboro, which operated under the City’s Sexually Oriented Business zoning. The nightclub has used various names over the past eight years including Sugar Bares, Lost Dimensions and Nikita’s. The City had alleged that the business permitted prostitution and that it was a source of recurrent and dangerous criminal activity.
In the settlement, the defendants admitted no wrongdoing and affirmatively denied all allegations by the City. Darryl McCarroll, the operator of the business, has agreed to close the business and to not operate a bar or sexually oriented business in Guilford County in the future. Landowner Clarence Ray Jernigan has agreed to not allow a sexually oriented business to operate on his property, located at 510 Farragut St., for the next seven years. Current signs on the property will be removed within 30 days. The final order was entered by consent of every party to the lawsuit. It resolved all claims.
“We want to commend the parties and their lawyers in this dispute,” said Greensboro Police Chief Tim Bellamy. “They listened to the concerns of the City and responded in a constructive manner. Each party agreed to do what was necessary and end this dispute. Settlements such as this are always preferable.”
Plans for 510 Farragut St. property are incomplete at this time.
